Family Dispute Resolution

Resolving a dispute following the breakdown of a marriage or relationship can be an emotional time.   In order to achieve the best possible outcome, it’s important that all variables and factors are considered. Time, expenses and the overall impact of the relationship has a massive effect on achieving the desired resolution.

Each method has its advantages and disadvantages and the costs differ depending on the required service. When resolving a family dispute, the last option is to take the dispute to court, however, circumstances may arise whereby it is the only option.

Our team recommends alternative dispute resolution wherever possible including mediation and arbitration.  Where appropriate we can refer you to the relevant specialist if we do not provide a particular service.

Voluntary Disclosure and Negotiations: Both parties can commit to voluntary full and frank disclosure by mutual exchange of Forms E. The financial information you have disclosed is then used to enter into discussions and negotiations with a view to reaching a financial settlement.

Round Table Meeting: A Round Table Meeting (RTM) is a meeting where the parties and their legal advisors can meet, with the objective of seeking a mutually acceptable resolution to their dispute. RTMs can take place prior to, or during court proceedings. If agreement can be reached there will be a significant saving in legal fees.

Mediation: If both parties in a dispute agree to undergo mediation, then a trained mediator, who acts impartially, helps to guide both parties. The mediator’s role is not to impose a decision or to judge the merits of the case but simply help both sides reach an agreement without having to go to court.  We frequently advise our clients who are mediating and assist with the legal formalities.

Arbitration: In the family arbitration process, the parties sign an agreement to be bound by the arbitrator’s award. The process is similar to court proceedings but is a condensed and less formal procedure and therefore can be less expensive.  It can be tailored to suit the needs of the parties.  It is also now possible for arbitration to be used in relation to disputes concerning children.
